Background
The Stockholm Convention on Persistent Organic Pollutants (POPs) agreed that all countries whom are signatories to the United Nations treaty can implement a full list of exemptions when they transpose the agreed restriction of UV-328 into their regulatory frameworks.
The current draft UK Persistent Organic Pollutants (Amendment) Regulations 2024 (POPs Regulation) does not include the full list of exemptions for UV-328 which have been outlined by the Stockholm Convention.
Department for Environment Food and Rural Affairs (DEFRA) are required to conduct a full Impact Assessment to support the Statutory Instrument for amendments to the POPs Regulation. Once the assessment, the Instrument will undergo an independent review by the Regulatory Policy Committee.
DEFRA have asked for BRC members answers to the following questions by the 28th January.
- How many BRC members are impacted by the UV-328 and DP ban?
- How many members are suppliers and how many are manufacturers?
- How many are micro, small, or medium sized businesses?
- How many impacted parts/finished articles are being imported/exported, and the value of these articles?
- What quantity of UV-328/ DP is contained in parts/finished articles?
- What is the anticipated cost of developing and/or testing alternatives? How many members will face this type of cost?
- What are the anticipated cost impacts once DP and UV-328 are replaced with alternative substances?
- What is the estimated cost to BRC members of not having an exemption for the use of Dechlorane Plus and UV-328, and could you provide a breakdown of these costs, such as lost revenues and production stoppage expenses?
- What familiarisation costs will BRC members face? This relates to reading and understanding regulations, disseminating information and staff training
