BRC Response to CMA Consultation on revised UCT Guidance
The BRC response calls for additional examples and further indications of what would be considered fair and unfair.
We note that the Guidance would mainly be used by legal experts but recognise that non-experts can also find it useful when engaging with legal teams.
There is a concern that the Guidance may go beyond the strict terms of the law in a few areas by emphasising the role of behavioural issues and also by a new concern on issues such as placement and appearance rather than the actual terms.
