BRC submits final response to Law Commission's consultation on Security of Tenure
The BRC has submitted its response to the Law Commission's consultation on the future of security of tenure. Thank you to all members who provided information and assisted in its development.
Key points from the response include:
- The Landlord and Tenant Act 1954 is not fundamentally broken.
- The contracting-out model of security of tenure, with protected tenancies as the default, must be retained to ensure the viability and stability of the retail tenancy model.
- Looking beyond the issue of security of tenure, there are a range of areas of the legislation which would benefit from modernisation to ensure that they are fit for purpose. These should be the focus of the second consultation.
