New PMO Rules - DBT writes to enforcers on transition

The new PMO rules come into effect next April.

Following a request from BRC members to make it clear to enforcers that it will be acceptable for retailers to transition to the new rules gradually - as long as the transition is in effect by the start date - DBT has written to Trading Standards to confirm this approach.

It has also written to the CMA along similar lines.

The note states

In development with stakeholders including industry, enforcers, and consumer groups, The Price Marking Order 2004 ( “PMO”) has been updated. These updates include new provisions to make price comparison easier for consumers and provide more structure for Industry. The PMO was updated by The Price Marking (Amendment) Order 2024 and The Price Marking (Amendment) Order 2025. To aid industry and enforcers, the Department of Business and Trade has published guidance Price Marking Order 2004: government guidance - GOV.UK. The new provisions will not commence until 6 April 2026, in order to give businesses sufficient time to bring themselves into compliance. In the run up to 06 April 2026, Enforcers should be aware that they may encounter settings where retailers are abiding by the new legislation, or a mixture of the old and the new requirements and adopt a pragmatic approach.
