Earlier this week, Government published its response to the consultation on extending the Right to Work (RtW) scheme beyond employees, confirming the proposals will go ahead, bringing a wider range of working arrangements into scope, including agency workers, some self-employed contractors, zero-hours workers and certain platform-based arrangements.
The updated statutory code of practice and guidance have now been published, with changes taking effect from 01 October.

In its response, Government recognises the need for clear guidance, streamlined processes and greater use of digital verification to support compliance. It has also acknowledged concerns raised during the consultation about implementation challenges and committed to supporting employers as the changes are rolled out.
However, on responsibility for conducting the checks, legal responsibilities could extend across a broader range of labour market arrangements, with potential impacts for businesses that rely on contingent labour.
