The Environment Agency published a regulatory position statement (RPS 255) setting out its enforcement position in relation to the capture, treatment, storage and use of the CO2 that meets food and beverage or industrial grade standards from anaerobic digestion (AD) plants.

This RPS applies if you are:

- capturing CO₂ produced from biogas upgrading at your AD plant to produce CO₂ that meets food and beverage or industrial grade standards

- treating, storing and using CO₂ at your AD plant or elsewhere to produce CO₂ that meets food and beverage or industrial grade standards
